1. Agreement to Terms
By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access our services.
Important: Our development services are primarily offered to clients in Sri Lanka. While our website is accessible globally, our business focus and expertise are tailored for the Sri Lankan market.
2. Eligibility
To use our services, you must:
- Have the authority to request and pay for services
- Provide accurate and complete project information
- Be able to communicate clearly for project requirements
Note: If you are under 18, please ensure you have parental/guardian consent for the project.
3. Our Services
Service Description
LankaWeb provides the following services:

Service Limitations
- Services are subject to availability
- We reserve the right to refuse service to anyone
- Complex projects may require additional time and cost
- Third-party API limitations may affect service delivery
- Our primary expertise is tailored for Sri Lankan market needs
4. Payments and Refunds
Payment Terms
We use milestone-based payments for all projects to ensure fairness and transparency:
- All projects: Divided into clear milestones with payments at each stage
- Work begins only after agreement on milestones and payments
- Payments are required before moving to the next milestone
- Final files/code are delivered only after all payments are complete
Example Milestone Structure:
- Milestone 1 (Start): Requirements gathering & planning
- Milestone 2 (Progress): Development/implementation
- Milestone 3 (Completion): Testing & final delivery
Note: Specific milestone amounts and stages are customized for each project and agreed upon before work begins.
Refund Policy
- No refunds for completed milestones - Once a milestone is delivered and approved, payment is non-refundable
- Active milestone: If a project is cancelled during a milestone, client pays for work completed up to that point
- Future milestones: No payment required for milestones not yet started
- Digital products: No refunds once files/code are delivered
- Disputes: Any payment disputes must be raised within 7 days of milestone completion
Fair Practice: With milestone payments, you only pay for work actually completed. If you cancel, you only pay for milestones delivered up to that point.
Important: All payments are final. Please review project requirements carefully before making payment.
5. Intellectual Property
Client Ownership
Upon full payment, you own:
- The final delivered website/code
- Design elements created specifically for your project
- Custom functionality developed for your project
Our Ownership
We retain ownership of:
- Our proprietary code libraries and frameworks
- Generic templates and reusable components
- Our brand name, logo, and website content
Third-Party Assets
You are responsible for:
- Licensing any third-party assets (images, fonts, etc.)
- Ensuring you have rights to any content you provide
- Complying with third-party service terms (WhatsApp API, etc.)
6. Prohibited Uses
You agree not to use our services for:
- Illegal activities or promoting illegal content
- Malware, viruses, or harmful code distribution
- Spamming, phishing, or fraudulent activities
- Adult content, gambling, or prohibited substances (where illegal in Sri Lanka)
- Hate speech, harassment, or discrimination
- Copyright infringement or intellectual property theft
- Circumventing security measures
- Activities that violate Sri Lankan laws
Our Rights
If we discover prohibited use:
- During development: We may immediately terminate the project
- After delivery: We reserve the right to refuse future services
- Legal violations: We may report illegal activities to authorities
- No refunds: No refunds will be provided for terminated projects due to prohibited use
Client Responsibility: You are solely responsible for how you use the deliverables we provide.
7. Limitation of Liability
To the maximum extent permitted by Sri Lankan law:
- Our total liability shall not exceed the amount paid for services
- We are not liable for indirect, incidental, or consequential damages
- We are not liable for third-party service outages or issues
- We are not liable for data loss or security breaches
- We are not liable for delays beyond our reasonable control
- We are not liable for issues arising from client-provided content or requirements
8. Service Modifications and Termination
Service Changes
We may:
- Modify or discontinue services at any time
- Change pricing with 30 days notice
- Update these Terms with notice on our website
Termination
We may terminate services if:
- You violate these Terms
- You fail to make timely payments
- Required for legal compliance
- We discontinue the service
- Communication breaks down and project cannot proceed
9. Dispute Resolution
Any disputes shall be resolved as follows:
- Informal negotiation through WhatsApp/email (30 days)
Governing Law: These Terms are governed by and construed in accordance with the laws of Sri Lanka.
